Welcome to AirVia Travel (“AirVia Travel, LLC,” “Company,” “we,” “our,” or “us”)! These Terms of Service (“Terms”) govern your access to and use of our websites, mobile applications, and services (collectively, the “Service”). Please read them carefully before using the Service.
By using our Service, you agree to be bound by these Terms and our Privacy Policy. If you don’t agree, you may not use the Service.
1. Eligibility & Account Registration
You must be at least 18 years old to use our Service. By creating an account, you agree to provide accurate, current, and complete information and to maintain the security of your login credentials. You’re responsible for all activities under your account.
2. Service Overview
The Service is designed to help users plan, organize, and book travel experiences, including flights, hotels, and itineraries. We may display travel content and facilitate bookings through third-party providers, but we do not sell travel products directly.
3. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll post the updated version with a new effective date. We’ll notify you of any material changes through the Service or by email. Continued use of the Service constitutes acceptance of the revised Terms.

You agree not to use the Service in ways that:

5. Bookings, Cancellations, and Payments
Bookings are made through third-party partners. Our Service may redirect you to those providers or submit your information to complete a booking. Your agreement is with the third party, and their terms apply.

We do not guarantee availability, pricing accuracy, or changes made by those providers. Any cancellations or changes are subject to the third party’s policies. We are not responsible for errors or issues in third-party bookings.

If we process payments on your behalf, your payment info will be handled by a third-party processor under their terms.
6. Promotions & Rewards
From time to time, we may offer promotional rewards (e.g., cashback or gift cards) for first-time bookings. These promotions may be subject to eligibility requirements, minimum spend thresholds, or limited availability.
We reserve the right to change or cancel any promotion at our sole discretion, especially in cases of suspected abuse or fraud.
7. Subscriptions
Some features may be available through a paid subscription. Subscription terms (including renewal, cancellation, and billing) will be clearly disclosed at the time of purchase. Fees are non-refundable unless required by law.
8. Intellectual Property
All content, trademarks, and technology on the Service belong to us or our licensors. You may not copy, modify, distribute, or create derivative works based on our Service unless expressly permitted.
You retain rights to content you post, but you grant us a license to use it in connection with operating and improving the Service, including for training our AI models and enhancing travel recommendations.
9. Third-Party Services
We may link to or embed content from other services (e.g., maps, booking engines, social platforms). We are not responsible for the practices, content, or terms of these third-party services.
10. Termination
We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, particularly if you violate these Terms.

11. Disclaimers
The Service is provided “as is” and “as available.” We make no guarantees about accuracy, availability, or fitness for any particular purpose. We are not liable for the conduct of users or third-party providers.
Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability to you for any claims relating to the Service will not exceed $100 or the amount you’ve paid us in the last 6 months—whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, or liabilities resulting from your use of the Service, your content, or your violation of these Terms.
14. Dispute Resolution
Most issues can be resolved informally by contacting us. If not, you agree to resolve disputes through binding arbitration (not in court), except for small claims or injunctive relief. You may not bring class actions against us.
Arbitration will be conducted under the AAA rules in the state of California unless we agree otherwise.
15. General
These Terms constitute the entire agreement between you and us. If any part is found unenforceable, the rest remains in effect. You may not transfer these Terms without our consent. We may assign them freely.
